The following decisions were rendered Wednesday and Thursday, Feb. 15-16, 2012, in Carroll County District Court with the Hon. Elizabeth Chandler presiding.

CIVIL

Brandon J. Walker, 20, show cause, deferred installment payment, owes $193, continued to May 10.

Colson Stephens, 23, speeding 26 mph over/greater, merge; improper passing, guilty, $50 fine plus costs; reckless driving, guilty, to State Traffic School; failure of owner to maintain required insurance/security, first offense, proof shown, dismissed.

Final Judgments

Daniel Shuck, 37, pleaded guilty to first-degree promoting contraband, a class D felony and was sentenced to two years imprisonment and fined $1,000, said sentence is to run consecutive to any back up time, the Sheriff of Carroll County will deliver the defendant to the custody of the Department of Corrections at such location within this Commonwealth as the department designates, any cash/property bond posted may be released at this time.

John David Pate, 32, pleaded guilty to two counts of flagrant nonsupport, a class D felony, and was sentenced to five years on each count and fined $1,000 for each count, with said sentences to run concurrent to each other for effectively one five year sentence, a fine of $1,000 and court costs, the court suspends the fine, public advocacy fee and court costs, the defendant was placed on non-reporting probation for a period of five years, or until such time as his child support arrearages are paid in full but no less than five years, effective Feb. 6, 2012, any cash/property bond posted may be refunded at this time.

Sharon M. O’Banion, 32, pleaded guilty on count one to first-degree possession of a controlled substance, first offense, a class D felony, and was sentenced to three years imprisonment and a fine of $1,000; on count two she pleaded guilty to possession of drug paraphernalia, first offense, a class A misdemeanor, and was sentenced to 12 months imprisonment and fined $500, with said sentences to run concurrent to each other for effectively one three year sentence, a fine of $1,000 and court costs, the defendant was placed on probation under the supervision of the Division of Probation and Parole of the State of Kentucky for three years effective Feb. 6, 2012, and is subject to their conditions, any cash/property bond posted may be released at this time.

Robert C. Garrett, 36, pleaded guilty on count one to first-degree possession of a controlled substance, first offense, a class D felony, and was sentenced to three years imprisonment and a fine of $1,000; on count two he pleaded guilty to possession of drug paraphernalia, first offense, a class A misdemeanor, and was sentenced to 12 months imprisonment and fined $500, with said sentences to run concurrent to each other for effectively one three year sentence, a fine of $1,000 and court costs, the defendant was placed on probation under the supervision of the Division of Probation and Parole of the State of Kentucky for three years effective Feb. 6, 2012, and is subject to their conditions, any cash/property bond posted may be released at this time.

Melissa Ann Adair, 34, pleaded guilty on count one to theft of a controlled substance, a class D felony and was sentenced to three and a half years imprisonment and fined $1,000; on count two she pleaded guilty to operating a motor vehicle under the influence, first offense within a five year period, and was sentenced to 30 days imprisonment and fined $500, revocation of license/license plates for 120 days and a DUI service fee, with said sentences to run concurrent to each other for effectively one three and a half year sentence, a fine of $1,000 and court costs, the defendant was placed on probation under the supervision of the Division of Probation and Parole of the State of Kentucky for five years effective Feb. 6, 2012, and is subject to their conditions, any cash/property bond posted may be released at this time.

Indictments

Daniel L. Powers, 26, was indicted on counts one and two for second-degree trafficking in a controlled substance, punishable by imprisonment for not less than one year nor more than 3 years in the penitentiary and a fine of not less than $1,000 nor more than $10 000 in that he knowingly and unlawfully trafficked in a schedule III narcotic, namely hydrocodne.
