INDICTMENTS
Melissa Ann Adair, 34, was indicted on count one for theft of a controlled substance, a class D felony, punishable by imprisonment for not less than one year nor more than five years in the penitentiary and a fine of not less than $1,000 nor more than $10,000 in that she unlawfully took or exercised control over a schedule II controlled substance, namely Fentanyl Transdermal patches, belonging to another with the intent to deprive the owner thereof; on count two she was indicted for operating a motor vehicle under the influence, first offense within a five year period, punishable by imprisonment for not less than 48 hours nor more than 30 days in the county jail and or a fine of not less than $200 nor more than $500, revocation of license and license plates for a period of not less than 30 days nor more than 120 days, and a service fee, in that she was operating a motor vehicle under the influence; on count three Adair was indicted for becoming a second-degree felony offender, punishable by imprisonment for not less than five years nor more than 10 years in the penitentiary on the offense set forth above in count one, in that she is more than 21 years of age and stands convicted of a felony after having been convicted of a prior felony, namely by final judgment of the Carroll Circuit Court entered on or about July 25, 2005, for first-degree possession of a controlled substance, Cocaine, first offense, and tampering with physical evidence for which she was sentenced to three and a half years imprisonment; that the defendant was sentenced to a term of imprisonment of one year or more, that she was over the age of 18 at the time the offense was committed and she completed service of the sentence imposed on the previous felony conviction within five years prior to the date of the commission of the felony for which she now stands convicted or she was on or discharged from probation, parole, post incarceration supervision, conditional discharge, conditional release, furlough, appeal bond, or any other form of legal release from any of the previous felony convictions at the time of commission of the felony for which she now stands convicted within five years prior to the date of commission of the felony for which she now stands convicted.
Bobby K. Mitchell, 40, was indicted on count one for manufacturing Methamphetamine, first offense, a class B felony, punishable by imprisonment for not less than 10 years nor more than 20 years in the penitentiary and a fine of not less than $1,000 nor more than $10,000 in that he knowingly and unlawfully manufactured Methamphetamine or with the intent to manufacture Methamphetamine, he possessed two or more chemicals or two or more items of equipment for the manufacture of Methamphetamine, first offense; on count two he was indicted for first-degree possession of a controlled substance, first offense, a class D felony, punishable by imprisonment for not less than one year nor more than three years in the penitentiary and a fine of not less than $1,000 nor more than $10,000 in that he knowingly and unlawfully possessed a controlled substance, namely Methamphetamine, first offense; on count three he was indicted for committing the crime of possession of drug paraphernalia, first offense, a class A misdemeanor, punishable by imprisonment for not more than 12 months in the county jail and or a fine of not more than $500, in that he possessed drug paraphernalia; on count four Mitchell was indicted for operating a motor vehicle under the influence, first offense within a five year period, punishable by imprisonment for not less than 48 hours nor more than 30 days in the county jail and or a fine of not less than $200 nor more than $500, revocation of license and license plates for a period of not less than 30 days nor more than 120 days, a service fee, in that he was operating a motor vehicle while under the influence; on count five he was indicted for speeding, punishable by a fine, in that he was driving a vehicle upon a highway in excess of the speed limit.
James Howard Ferrell, 32, on count one was indicted for theft by unlawful taking or disposition of property with a value of $10,000 or more, a class C felony, punishable by imprisonment for not less than five years nor more than 10 years in the penitentiary and a fine of not less than $1,000 nor more than $10,000 in that he unlawfully took or exercised control over movable property of another, namely a 2010 Ford Escape, with a value of $10,000 or more, with the intent to deprive the owner thereof; on count two he was indicted for committing the crime of operating a motor vehicle while his license was suspended, a class B misdemeanor, punishable by imprisonment in the county jail for not more than 90 days and or a fine of not more than $250 in that he was operating a motor vehicle while his driver’s license was suspended.
Kellie Marie Martin, 42, was indicted on count one for first-degree possession of a controlled substance, second offense, a class D felony, punishable by imprisonment for not less than one year nor more than three years in the penitentiary and a fine of not less than $1,000 nor more than $10,000 in that she knowingly and unlawfully possessed a schedule II narcotic drug, namely Oxycodone/Oxycontin, second offense; on count two she was indicted for second-degree possession of a controlled substance, a class A misdemeanor, punishable by imprisonment for not more than 12 months in the county jail and/or a fine of not more than $500, in that she knowingly and unlawfully possessed a controlled substance, namely Hydrocodone, a schedule III controlled substance; on count three Martin was indicted for third-degree possession of a controlled substance, a class A misdemeanor, punishable by imprisonment for not more than 12 months and/or a fine of not more than $500, in that she knowingly and unlawfully possessed a schedule IV controlled substance, namely Alprazolam; on count four she was indicted for possession of drug paraphernalia, first offense, a class A misdemeanor, punishable by imprisonment for not more than 12 months in the county jail and/or a fine of not more than $500, in that she possessed drug paraphernalia.
Robert L. Halbrendt, 27, was indicted for first-degree possession of a controlled substance, first offense, a class D felony, punishable by imprisonment for not less than one year nor more than three years in the penitentiary and a fine of not less than $1,000 nor more than $10,000 in that he knowingly and unlawfully possessed a schedule II narcotic drug, namely Methadone, a first offense.
Douglas W. Smith, 41, was indicted for flagrant non-support, a class D felony, punishable by imprisonment for not less than one year nor more than five years in the penitentiary and a fine of not less than $1,000 nor more than $10,000 in that he persistently failed to provide support which he can reasonably provide and which he knows he has a duty to provide by virtue of a court order for his child, and said failure has resulted in an arrearage in excess of $1,000.
